Local reserved powers and agricultural housing permitsDIVISION 13. HOUSING › PART 1. EMPLOYEE HOUSING ACT › CHAPTER 2. Application and Scope

Key provisions · Claude summary, not statute text

Local jurisdictions keep key land use powers, but permits for agricultural employee housing get firm timelines.

  • Reserved local powers. Local use zone, fire zone, property line, water supply, and sewage disposal requirements are reserved to local jurisdictions, except as provided in §§ 17021.5, 17021.6, and 17021.8. (a)
  • 60-day decision. The local building or health department has up to 60 days to approve or deny a complete application for agricultural employee housing, or less if the Permit Streamlining Act requires. (b)(1)
  • Itemized denials. A procedural denial must occur within 30 days and itemize the defects, and a substantive denial must itemize all substantive defects. (b)(1)
  • State backstop approval. If the local department misses the deadline, the Department of Housing and Community Development may approve the application if the plans meet applicable codes and health and safety requirements. (b)(2)
  • CEQA still applies. The section does not exempt an application or permit request from the California Environmental Quality Act. (c)
  • Cost recovery. The department may recover its review costs from the local department, up to the published plan check fee. (e)
