Key provisions · Claude summary, not statute text

Exempts from CEQA multifamily “residential or mixed-use housing projects” on sites of five acres or less in unincorporated urbanized areas that meet density, consistency, and environmental conditions, until January 1, 2032.

  • Definitions. Defines “residential or mixed-use housing project” (multifamily only, or mixed use with at least two-thirds of square footage residential) and “substantially surrounded” (at least 75 percent of the perimeter adjoins or is across an improved right-of-way from qualified urban uses, with the rest planned for such uses in a plan with a certified EIR). (a)
  • Consistency and density. The project must be consistent with the general plan and zoning, contain six or more multifamily units, and have residential density, as determined on substantial evidence, at least the greater of the average density of adjoining residential properties, the average within 1,500 feet, or six units per acre. (b)(1)–(2)
  • Site requirements. The project must be in an unincorporated area on a site of no more than five acres “substantially surrounded” by qualified urban uses, on legal parcels wholly within a Census urbanized area or urban cluster, with no value as habitat for endangered, rare, or threatened species, and adequately served by utilities and public services. (b)(3)–(4), (b)(6)–(7)
  • No significant effects. Approval must not result in significant effects on transportation, noise, air quality, greenhouse gas emissions, or water quality. (b)(5)
  • Exceptions. The exemption does not apply if there are significant cumulative impacts of successive similar projects, unusual circumstances, damage to scenic resources within a state scenic highway, a site on a § 65962.5 list, a substantial adverse change to a historical resource, or a substantial adverse impact to tribal cultural resources. (c)
  • Notice. A lead agency approving an exempt project must file a notice with the Office of Planning and Research and the county clerk as specified in § 21152(b) and (c). (d)
  • Sunset. The section remains in effect only until January 1, 2032, and is then repealed. (e)
