Key provisions · Claude summary, not statute text

Establishes the streamlined, ministerial approval process, timelines, and related rules for housing developments that qualify under §§ 65912.120–65912.123.

  • Consistency review. The local government must determine in writing whether the project is consistent with the objective standards within 60 days (150 or fewer units), 90 days (more than 150 units), or 30 days for resubmittals, giving an exhaustive list of conflicts with explanations and requesting no new information later. (a)(1)–(2)
  • Approval deadlines. Once found consistent, the project must be approved within 60 days (150 or fewer units) or 90 days (more than 150 units); if the required documentation is not provided, the project is deemed to satisfy the standards. (a)(3)–(4)
  • Standard of review. A project is consistent if substantial evidence would allow a reasonable person to conclude so, and is not in conflict solely because application materials are missing; the determination is not a CEQA “project.” (b), (c)
  • Design review. Design review by the planning commission or equivalent must be objective, limited to streamlining criteria and adopted objective design standards, and may not inhibit, chill, or preclude ministerial approval. (d)
  • Coastal zone. Projects in non-excluded coastal zone areas require a coastal development permit, which must be approved if consistent with the objective standards of the certified LCP or land use plan. (e)
  • Density bonus. Projects are eligible for density bonus, incentives, concessions, waivers, and parking ratios under § 65915 (but not to reduce permitted ground-floor retail), may use them to deviate from height and setback standards, without triggering discretionary or CEQA review or LCP inconsistency; maximum allowable density is that set by § 65912.123(b)(1)–(2). (f)
  • Fee offsets. Fees must be offset for demolished or changed existing uses so they reflect only incremental impact; offsets are not refundable. (g)
  • Housing protections; subdivisions. The project must satisfy Article 2 (§ 66300.5 et seq.) protections, and a subdivision consistent with objective local subdivision standards is exempt from CEQA. (h), (i)
  • Parcel exemptions. A local government may exempt parcels by ordinance with written findings that it has identified substitute parcels, reclassified them for development or higher densities and heights, with no net loss of total or lower income capacity and affirmative furthering of fair housing, has completed sixth-cycle rezonings, and has mapped and posted exempted and reclassified parcels online. (j)
  • Environmental assessment. Approval must require a phase I environmental assessment and, if a recognized environmental condition is found, a preliminary endangerment assessment, with releases or exposure hazards mitigated before a certificate of occupancy. (k)
  • Post-approval. Approval expiration, modifications, subsequent permits, and public improvements follow § 65913.4(g), (h), and (i)(2)–(3). (l), (m), (o), (p)
  • Prohibited requirements. The local government may not impose requirements, including increased fees or inclusionary requirements, because a project qualifies for streamlining, and easements do not make a property ineligible. (n), (q)
  • Ordinances; HAA. A local implementing ordinance is not a CEQA “project,” and the Housing Accountability Act (§ 65589.5) applies. (r), (s)
