Sets the site criteria a development must meet to qualify for streamlined, ministerial review under § 65912.124.

  • Zoning. The site must be in a zone where office, retail, or parking are a principally permitted use. (a)
  • Urbanized area. The parcel must be in a city that includes some portion of a Census-designated urbanized area, or in an unincorporated area wholly within one. (b)
  • Corridor or campus. The site must abut a commercial corridor with at least 50 feet of frontage, or be in a campus development zone. (c)
  • Site size. The site may not exceed 20 acres, or 100 acres for a regional mall. (d)
  • Urban infill. At least 75 percent of the site perimeter must adjoin parcels developed with urban uses; parcels separated only by a street or path count as adjoined. (e)
  • Industrial adjacency. The site may not be on or adjoin a site where more than one-third of the square footage is “dedicated to industrial use,” meaning currently industrial, most recently permitted as industrial and occupied within three years, or designated industrial in a general plan adopted before January 1, 2022, without residential as a principally permitted use. (f)
  • Environmental exclusions. The site must meet the § 65913.4(a)(6) criteria, except clause (iv) of subparagraph (A). (g)
  • Housing protections. The site is ineligible if development would demolish rent-restricted, rent-controlled, or tenant-occupied housing (within 10 years) or a registered historic structure, if tenant-occupied housing was demolished within 10 years, if it contains one to four units, if it is vacant and zoned for housing but not multifamily, or if it is a mobilehome, RV, or special occupancy park. (h)
  • Neighborhood plans. In a neighborhood plan area, the plan must permit multifamily housing on the site. (i)
  • Vacant sites. A vacant site may not contain unmitigable tribal cultural resources identified through consultation, or lie within a very high fire hazard severity zone. (j)
