Labor standardsTITLE 7. PLANNING AND LAND USE › DIVISION 1. PLANNING AND ZONING › CHAPTER 4.1. Affordable Housing and High Road Jobs Act of 2022 › ARTICLE 4. Labor Standards

Key provisions · Claude summary, not statute text

Sets prevailing wage and related labor standards for developments approved under the commercial-zone streamlining articles (Articles 2 and 3).

  • Certification. The proponent must require the standards in construction contracts and certify to the local government that they will be met. (a)
  • Prevailing wages. For portions that are not a public work, all construction workers must be paid at least the general prevailing rate of per diem wages (apprentices at the apprentice rate), and the requirement must be included in all contracts. (b)(1)–(2)
  • Contractor duties. Contractors and subcontractors must pay prevailing wages, maintain and verify payroll records under Labor Code § 1776 (unless covered by a qualifying “project labor agreement”), and be registered under Labor Code § 1725.6. (b)(3)
  • Enforcement. Prevailing wage obligations may be enforced by the Labor Commissioner within 18 months after completion, an underpaid worker, or a joint labor-management committee, with liquidated damages for contractors, subcontractors, and sureties; this does not apply under a qualifying project labor agreement. (c)
  • Collective bargaining; workweek. Employer payment rules may be varied by a bona fide collective bargaining agreement, and alternative workweek schedules are permitted. (d), (e)
  • DIR notice. For non-public-work portions, the proponent must give notice of all contracts to the Department of Industrial Relations under Labor Code § 1773.35. (f)
