Gov. Code § 65912.160

Department oversight and local ordinancesTITLE 7. PLANNING AND LAND USE › DIVISION 1. PLANNING AND ZONING › CHAPTER 4.1.5. Transit-Oriented Development

Key provisions · Claude summary, not statute text

Gives the department oversight of the chapter and sets the process for local ordinances implementing it, including department review and limited exemptions.

  • Department oversight. The department oversees compliance and, by July 1, 2026, promulgates standards on counting capacity under the chapter in the § 65583.2 inventory of land suitable for residential development. (a)–(b)
  • Local ordinance. A local government may enact an ordinance to make its zoning code consistent with the chapter, with objective standards demonstrated by a preponderance of evidence not to physically preclude, alone or in concert, the § 65912.157 standards; the ordinance is not a CEQA project. (c)
  • Submittals. The draft ordinance goes to the department at least 14 days before adoption, and the department may report written findings; the enacted ordinance is submitted within 60 days. (d)(1)–(2)
  • Department finding. Within 90 days, plus 30 more if requested, the department finds whether the ordinance substantially complies. If it gives no written findings within that period, the ordinance is deemed compliant for purposes of penalties, including under § 65912.157(m). (d)(3)
  • Noncompliance. If the department finds noncompliance, it gives the local government up to 60 days to respond; the local government must amend the ordinance or adopt it with findings explaining why it complies, or the department may notify the Attorney General. (d)(4)–(6)
  • Walking path exemption. The ordinance may exempt areas within one-half mile of a stop where findings supported by substantial evidence show no walking path of less than one mile to the stop. (e)(1)
  • Industrial employment hub. A local government with at least 15 stops may exempt a contiguous area of at least 250 acres designated as employment lands in its general plan by January 1, 2025, primarily dedicated to industrial use, where housing is not a permitted use. (e)(2)
  • Regional maps. Each metropolitan planning organization creates a map of stops and zones by tier under department guidance, which has a rebuttable presumption of validity. (f)
