Gov. Code § 65915.5

Condominium conversionsTITLE 7. PLANNING AND LAND USE › DIVISION 1. PLANNING AND ZONING › CHAPTER 4.3. Density Bonuses and Other Incentives

Key provisions · Claude summary, not statute text

Requires a city or county to grant a density bonus or equivalent incentives when an apartment-to-condominium conversion includes specified affordable units, subject to eligibility limits.

  • Bonus requirement. If an applicant converting apartments to condominiums provides at least 33% of units to low or moderate-income persons or 15% to lower income households, and pays reasonable administrative costs, the city or county must grant a density bonus or other incentives of equivalent financial value, and may impose reasonable conditions, including continued affordability for later buyers. (a)
  • Definitions. “Density bonus” means a 25% increase in units over the number of apartments, within the existing structures; “other incentives of equivalent financial value” do not require cash payments but may include reducing or waiving conversion conditions. (b), (c)
  • Preliminary proposal. An applicant may submit a preliminary proposal before formal map requests; within 90 days of a written proposal the city or county must state in writing how it will comply, and must adopt procedures including legislative body approval of the means of compliance. (d)
  • No approval mandate. The section does not require approval of a condominium conversion. (e)
  • Ineligibility. No bonus is available if the apartments already received a § 65915 bonus, or if the property has (or had within five years) rent-restricted, rent-controlled, or lower income–occupied rental units, unless they are replaced per § 65915(c)(3)(B) and the project meets the (a) percentages or is 100% lower or very low income. (f), (g)
  • Pre-2015 applications. Subdivision (g) does not apply to applications submitted or processed before January 1, 2015. (h)
