Keeps density bonus entitlements that are not yet secured from raising ground rent on hotel and motel land under existing leases.

  • Ground rent valuation. Land improved with an operating hotel or motel may not be valued, when ground rent is established, adjusted or reset under an existing lease, based on density bonuses, concessions or incentives, or waivers under § 65915, unless those density increases are entitled and vested as of the valuation date, including all required discretionary land use approvals and permits. (a)
  • Density bonus rules unchanged. The section does not change the requirements for obtaining a density bonus under § 65915. (b)
