Floor area ratio bonus near transitTITLE 7. PLANNING AND LAND USE › DIVISION 1. PLANNING AND ZONING › CHAPTER 4.3. Density Bonuses and Other Incentives

Key provisions · Claude summary, not statute text

Authorizes cities and counties to adopt an ordinance granting a floor area ratio bonus, in lieu of a units-per-acre density bonus, to eligible affordable multifamily housing near transit, with parking caps and square-foot-based impact fees.

  • Eligible development. An “eligible housing development” is multifamily with five or more units, on an urban infill site in a transit priority area or within one-half mile of a major transit stop, zoned for residential or mixed use at a minimum of 20 units per acre (no low density residential or exclusive nonresidential land), meets § 65915(c) replacement requirements, has at least 20% of units affordable to households at or below 50% of AMI for at least 55 years, and complies with underlying height limits. (a)(1)
  • Definitions. Defines “floor area ratio” (gross building area excluding structured parking divided by net lot area), “gross building area,” “floor area ratio bonus,” “major transit stop,” and “transit priority area.” (a)(2)–(5)
  • FAR bonus ordinance. A city council or board of supervisors may adopt an ordinance to grant, on request, a FAR bonus in lieu of a density bonus. Allowable gross residential floor area equals base density (units per acre) × site area in square feet ÷ 43,560 × 2,250. (b)
  • Parking cap. Parking may not exceed 0.1 spaces per unit affordable at or below 120% of AMI and 0.5 spaces per market-rate unit. (c)
  • Impact fees. A jurisdiction adopting the ordinance must let applicants calculate impact fees by square foot rather than per unit. (d)
  • Mixed use and concessions. Nonresidential FAR limits still apply to the nonresidential portion of mixed-use projects, and applicants may also request § 65915(d) incentives or concessions. (e), (f)
  • Construction. The section does not supersede other chapter sections, does not bar FAR bonuses on different terms, and does not relieve a jurisdiction of § 65915 compliance. (g)
