Key provisions · Claude summary, not statute text

Lets a local agency comply with the chapter through its own transit-oriented development alternative plan that keeps equivalent zoned capacity, and allows interim site exclusions.

  • Equivalent capacity. The plan must maintain at least the same total net zoned capacity, in total units and residential floor area, as the chapter provides across all transit-oriented development zones, measured by subtracting current units or floor area from what applicable standards allow. (a)(1)
  • Site density floor. The plan may not reduce maximum allowed density on any residential site by more than 50 percent below the chapter, except for sites in very high fire hazard severity zones or the state responsibility area, sites vulnerable to one foot of sea level rise, and locally registered historic sites up to 10 percent of a zone's eligible area. Sites within one-half mile of a Tier 2 stop may not go below 30 units per acre with a residential floor area ratio of 1.0. (a)(2)
  • Zone capacity and counting. The plan may not reduce any zone's capacity by more than 50 percent; a site's counted capacity may not exceed 200 percent of the chapter's maximum density, excluded sites do not count, and voluntary local housing incentive programs are included in calculations. (a)(3)–(4)
  • Existing plans. An existing local transit-oriented zoning ordinance, overlay zone, specific plan, zoning incentive ordinance, or existing program may serve as the plan if it meets the section's requirements. (a)(5), (e)
  • Interim exclusions. Until one year after adoption of the seventh housing element revision, § 65912.157 does not apply to sites excluded by ordinance under § 65912.160 that allow at least 50 percent of its standards, meet zone-wide or low-resource capacity thresholds, or are covered by an adopted alternative plan. (b)(1)(A)–(C)
  • Hazard and historic exclusions. Interim exclusions also cover sites in very high fire hazard severity zones or the state responsibility area, sites vulnerable to one foot of sea level rise, and sites with a historic resource on a local register as of January 1, 2025. (b)(1)(D)–(F)
  • Zoning map. A local government adopting an exclusion ordinance must show on its public zoning map which sites or zones are and are not covered by § 65912.157. (b)(2)
  • Housing element path. For the seventh and later revisions, a plan included in the housing element must analyze how it maintains at least equal feasible developable housing capacity, be included in the first draft submittal, and may supply sites for the inventory; otherwise the local government may adopt a plan the department deems compliant under § 65912.160. (c)
  • Effect of approval. Section 65912.157 does not apply in a jurisdiction with a department-approved plan in effect; approval is valid through the jurisdiction's next housing element amendment. (d)
