Key provisions · Claude summary, not statute text

Lets a local agency’s failure to adopt or certify a prepared CEQA document (negative declaration, addendum, EIR, or comparable document) for a qualifying infill housing project count as a “disapproval” under the Housing Accountability Act when specified conditions are met.

  • Site and location. Substantial evidence must show the project is not on a site listed in § 65913.4(a)(6)(A)–(C) or (E)–(K) or in a very high (or mapped high/very high) fire hazard severity zone; it must be on a legal parcel in an “urbanized area” near a “high-quality transit corridor” or “major transit stop,” in a “very low vehicle travel area,” “proximal” to six or more amenities, or mostly surrounded by urban uses; and its density must be at least 15 dwelling units per acre. (a)(1)–(3)
  • Prepared document. A negative declaration, addendum, EIR, or comparable document must have been prepared that, if adopted, would satisfy CEQA for the project. (a)(4)
  • Failure to act. The agency or its delegate must have held a meeting where the document was on the agenda and could have been adopted, but committed an abuse of discretion or failed to decide whether to require further study or adopt the document. (a)(5)
  • Applicant notice. The applicant must give timely written notice with record excerpts, and the agency must not have made a lawful determination within 90 days. Notice is timely within 35 days of a vote requiring further study; otherwise, after the CEQA deadline for completing the document (Pub. Resources Code § 21151.5 or other provision, or 180 days if none) has passed. (a)(6)
  • Abuse of discretion. Exclusively defined as requiring further study, in bad faith or without substantial evidence supporting a fair argument (for a negative declaration) or showing further study is legally required (for an addendum, EIR, or other document), rather than adopting the document. (b)(1)
  • Definitions. Also defines “high-quality transit corridor,” “major transit stop,” “proximal,” “urbanized area,” and “very low vehicle travel area” with the same meanings as § 65589.5.1. (b)(2)–(6)
  • Sunset. Repealed January 1, 2031. (c)
