Key provisions · Claude summary, not statute text

Requires ministerial tentative and final maps to subdivide qualifying townhome development projects into lots as small as 600 square feet.

  • Ministerial maps. A local agency shall ministerially consider, without discretionary review or a hearing, a tentative and final map for a townhome development project that meets § 65852.30 and the requirements of subdivision (a). (a)(1)
  • Eligible sites. Zoned for multifamily residential use, or underutilized and zoned exclusively single-family; not a transit-oriented development site under § 65912.157; not a mobilehome, RV, or special occupancy park; on an infill site if outside an urban area. (a)(2)
  • Parcels and ownership. New parcels of at least 600 square feet; units on fee simple lots, in a common interest development, a limited-equity housing cooperative, a community land trust, or a tenancy in common. (a)(3)–(5)
  • Housing protections. Not a site identified for lower income RHNA; no demolition of deed-restricted, rent-controlled, or recently tenant-occupied rent-controlled housing; no Ellis Act withdrawal within 15 years; no parcel that had five or more units in the past five years. (a)(6)–(8)
  • Excluded sites. Farmland, wetlands, very high fire hazard severity zones, hazardous waste sites, earthquake fault zones, flood hazard areas and floodways (with exceptions), conservation lands, protected species habitat, conservation easements, and historic resources. (a)(9)–(10)
  • Services and density. Served by a community water system and municipal sewer; any local minimum density, including the low end of a range, is no more than 50 units per acre. (a)(13)–(14)
  • Standards that cannot be required. Lot size, width, depth, or frontage minimums beyond the 600-square-foot floor, and formation of a homeowners’ association except as the Davis-Stirling Act requires; road maintenance agreements remain allowed. (b)
  • Sale of parcels. Parcels may not be sold, leased, or financed separately until built, existing, reserved as common area, or the last undeveloped parcel, unless the agency allows it by ordinance or map condition. (d)
  • Denial, CEQA, and lot splits. Denial only on a written public health and safety finding; approval is not a CEQA project; no urban lot split is required on parcels created under the section. (e)–(g)
