AB 2243

Housing development projects: objective standards: affordability and site criteria.Ch. 272, Stats. 2024 · chaptered 2024-09-19 · Later amended

Key provisions · Claude summary of the digest, not bill text

Made numerous changes to the Affordable Housing and High Road Jobs Act of 2022 (AB 2011) and the Middle Class Housing Act, expanding eligible sites and tightening local review timelines.

  • Regional malls. Allowed project sites up to 100 acres (rather than 20 acres) when the site is a regional mall, under both the Middle Class Housing Act and the AB 2011 mixed-income pathway.
  • Industrial and freeway sites. Narrowed the industrial-site exclusion to sites designated industrial in the pre-2022 general plan where residential uses are not principally permitted, and allowed sites within 500 feet of a freeway if buildings meet criteria such as centralized HVAC.
  • Conversions and historic. Prohibited density limits on mixed-income conversions of existing buildings to residential use, except as specified, and barred demolition of historic structures on a national, state, or local register.
  • Affordability base units. Clarified that mixed-income affordability thresholds apply only to base units, excluding density bonus units.
  • Definitions. Clarified that "use by right" bars any discretionary approval and makes no aspect of the project a CEQA "project," and expanded "urban uses" to include certain parks, parking, transit facilities, and retail uses.
  • Review timelines. Required written consistency determinations within specified timeframes, including 30 days for resubmittals, and approval within 60 or 90 days after a consistency finding, depending on unit count.
  • Parcel exemptions. Required local governments exempting parcels by ordinance to designate exempted and reclassified parcels on zoning maps.
  • Transition rule. Applied the Act as of December 31, 2024, to applications submitted by that date unless the proponent opts into the January 1, 2025, provisions; applied to charter cities.

SEC. 12

The Legislature finds and declares that the provision of adequate housing, in light of the severe shortage of housing at all income levels in this state, is a matter of statewide concern and is not a municipal affair as that term is used in Section 5 of Article XI of the California Constitution. Therefore, this act applies to all cities, including charter cities.

SEC. 13. The amendments adding subdivision (r) to Sections 65912.114 and 65912.124 of the Government Code made by this act do not constitute a change in, but are declaratory of, existing law.

SEC. 14

No reimbursement is required by this act pursuant to Section 6 of Article XIII B of the California Constitution because a local agency or school district has the authority to levy service charges, fees, or assessments sufficient to pay for the program or level of service mandated by this act, within the meaning of Section 17556 of the Government Code.
