Housing element: inventory of land: substantial compliance: rebuttable presumptions.Ch. 269, Stats. 2024 · chaptered 2024-09-19 · Current law

Key provisions · Claude summary of the digest, not bill text

Tightened housing element rezoning deadlines for the 7th and later cycles and created rebuttable presumptions of invalidity when HCD finds a housing element, or a local action, out of substantial compliance.

  • Rezoning deadlines. For the 7th and subsequent revisions, required rezoning within one year of the statutory housing element deadline, or within 3 years and 90 days if the jurisdiction timely submits drafts to HCD and adopts an element HCD finds in substantial compliance.
  • Override findings. Required planning agencies to submit to HCD the findings a legislative body makes when adopting an element despite HCD's noncompliance findings, required HCD to review those findings, and clarified (declaratory of existing law) that submission does not excuse required responsive actions.
  • Presumption for local actions. Created a rebuttable presumption of invalidity in legal actions challenging a jurisdiction's action or failure to act that HCD finds does not substantially comply with its adopted housing element or Housing Element Law obligations.
  • Presumption for elements. Created a rebuttable presumption of invalidity in challenges to a housing element or amendment that HCD has found does not substantially comply with Housing Element Law.
