Key provisions · Claude summary of the digest, not bill text

Revised the regional housing needs (RHNA) determination and allocation process, barring local objections in HCD-distributed regions, repealing the alternative process, and adjusting participation and adoption steps.

  • No local objection. Prohibited a city or county from filing an objection to the regional housing need determination in regions where HCD distributes the regional housing need.
  • Alternative process repealed. Repealed the alternative process for determining existing and projected housing need for the 4th and subsequent housing element revisions.
  • Broader participation. Expanded required solicitation of participation in the methodology and allocation process to include specified households with special housing needs.
  • HCD review shortened. Reduced HCD's time to report findings on an adopted allocation methodology from 90 days to 45 days.
  • Draft allocation timing. Authorized a council of governments to distribute the draft allocation plan upon adoption of a final methodology reviewed and accepted by HCD, under certain circumstances.
  • Adoption if no appeals. Allowed the draft allocation, if no appeals are filed, to be adopted under a specified procedure including a public hearing.
  • Bill coordination. Incorporated additional changes proposed by AB 3093 and AB 2597, each operative only if enacted and this bill was enacted last; applied to charter cities.

SEC. 6

The Legislature finds and declares that revising the housing needs assessment to combat the state’s housing crisis is a matter of statewide concern and is not a municipal affair as that term is used in Section 5 of Article XI of the California Constitution. Therefore, Sections 1, 1.5, 3, 3.5, 4, 4.5, and 5 of this act amending Sections 65584.01, 65584.04, 65584.05, and 65584.06 of the Government Code shall apply to all cities, including charter cities.

SEC. 7. Sections 1.5 and 3.5 of this bill incorporate amendments to Sections 65584.01 and 65584.04 of the Government Code proposed by both this bill and Assembly Bill 3093. Those sections of this bill shall only become operative if (1) both bills are enacted and become effective on or before January 1, 2025, (2) each bill amends Sections 65584.01 and 65584.04 of the Government Code, and (3) this bill is enacted after Assembly Bill 3093, in which case Sections 1 and 3 of this bill shall not become operative.

SEC. 8

Section 4.5 of this bill incorporates amendments to Section 65584.05 of the Government Code proposed by both this bill and Assembly Bill 2597. That section of this bill shall only become operative if (1) both bills are enacted and become effective on or before January 1, 2025, (2) each bill amends Section 65584.05 of the Government Code, and (3) this bill is enacted after Assembly Bill 2597, in which case Section 4 of this bill shall not become operative.

SEC. 9. No reimbursement is required by this act pursuant to Section 6 of Article XIII B of the California Constitution because a local agency or school district has the authority to levy service charges, fees, or assessments sufficient to pay for the program or level of service mandated by this act, within the meaning of Section 17556 of the Government Code.
