Housing omnibus.Ch. 360, Stats. 2021 · chaptered 2021-09-28 · Later amended

Key provisions · Claude summary of the digest, not bill text

Made housing omnibus changes covering ADU deed restrictions, density bonus treatment under the HAA, assisted housing preservation, and related tenant and mobilehome provisions.

  • ADU covenants. Voided deed restrictions on any real property that prohibit or unreasonably restrict ADUs or JADUs on single-family lots, while allowing reasonable restrictions.
  • HAA and density bonus. Provided that density bonus incentives, concessions, waivers, or reductions are not a basis for finding a project inconsistent under the HAA, declaring this existing law.
  • Supportive housing rents. Required by-right supportive housing rents to match the rent limits of the public financing program.
  • Assisted housing. Defined assisted housing developments as five or more units, revised offer and 5-year no-sale declaration procedures, and moved HCD's report to December 31 each year.
  • Mobilehome changes. Required 60 days' notice before seeking local change-of-use approval and excluded manufactured-home ADU rentals from the mobilehome park definition.
  • Other changes. Required HOA rental-cap amendments by July 1, 2022, extended redevelopment housing priority to descendants, and revised foreclosure and court record access rules.
