Set minimum floor area ratios and barred minimum lot size denials for qualifying 3- to 10-unit housing projects in multifamily and mixed-use zones.

  • Minimum FAR. Prohibited local agencies from imposing an FAR below 1.0 on projects of 3 to 7 units or below 1.25 on projects of 8 to 10 units that meet specified requirements.
  • Lot coverage and size. Barred lot coverage rules that preclude those FARs and denial of projects on existing legal parcels solely for not meeting minimum lot size.
  • Eligibility. Applied only to projects meeting specified criteria, including location in a multifamily residential or mixed-use zone.
  • CC&Rs voided. Voided covenants and governing documents that prohibit or unreasonably restrict use of the FAR standards, except reasonable restrictions.
  • HCD enforcement. Required HCD to identify violations and added the Housing Crisis Act of 2019 to laws for which HCD must give violation notice.

The Legislature finds and declares that the provision of adequate housing, in light of the severe shortage of housing at all income levels in this state, is a matter of statewide concern and is not a municipal affair as that term is used in Section 5 of Article XI of the California Constitution. Therefore, Section 2 of this act amending Section 65585 of, and Section 3 of this act adding Section 65913.11 to, the Government Code apply to all cities, including charter cities.

SEC. 5. Section 2.5 of this bill incorporates amendments to Section 65585 of the Government Code proposed by both this bill and Assembly Bill 215. That section of this bill shall only become operative if (1) both bills are enacted and become effective on or before January 1, 2022, (2) each bill amends Section 65585 of the Government Code, and (3) this bill is enacted after Assembly Bill 215, in which case Section 2 of this bill shall not become operative.
