AB 1398

Planning and zoning: housing element: rezoning of sites: prohousing local policies.Ch. 358, Stats. 2021 · chaptered 2021-09-28 · Later amended

Key provisions · Claude summary of the digest, not bill text

Shortened the rezoning deadline for jurisdictions that miss the housing element adoption deadline and conditioned their compliance on completing that rezoning.

  • One-year rezoning. Required a local government that fails to adopt an HCD-compliant housing element within 120 days of the statutory deadline to complete required rezoning no later than one year from the statutory deadline.
  • Compliance condition. Prohibited a jurisdiction that adopts its housing element more than one year after the statutory deadline from being found in substantial compliance until required rezoning is completed, as specified.
  • 4-year revisions. Specified that the 4-year housing element revision requirement applies until the 6th revision due date, and that adopting a compliant 6th revision satisfies any 4-year obligation.
  • Coordination with AB 1304. Incorporated additional changes to Government Code Sections 65583 and 65583.2 proposed by AB 1304, operative only if both were enacted and this bill was enacted last.
