H-2A worker housing: state funding: streamlined approval process for agricultural employee housing development.Ch. 866, Stats. 2019 · chaptered 2019-10-13 · Current law

Key provisions · Claude summary of the digest, not bill text

Prohibited state funding for housing used to meet federal H-2A worker housing requirements and created a streamlined, ministerial approval process for agricultural employee housing operated by HCD-certified affordable housing organizations.

  • H-2A funding ban. Prohibited state funding for predevelopment, development, or operation of housing used to comply with federal H-2A worker housing requirements and required recipients who used such funding to reimburse the state. Exempted agreements entered into before January 1, 2020.
  • Tenant rights. Provided that tenants in agricultural employee housing have all rights applicable to employee housing residents, including under the California Fair Employment and Housing Act and tenant rights laws.
  • Certified operators. Required HCD to establish an application and review process to certify qualified affordable housing organizations to operate agricultural employee housing and to maintain a roster of certified organizations.
  • Streamlined ministerial approval. Allowed development proponents to apply for streamlined, ministerial approval of agricultural employee housing, not subject to a conditional use permit, if operated by a certified organization and other requirements are met. Deemed the development compliant with site restrictions if the local government did not notify the proponent of noncompliance within a specified time, and made approvals exempt from CEQA.
  • 35-year affordability. Required the organization and landowner to maintain affordability for at least 35 years and required the landowner to select an alternative certified operator within 90 days if the organization stopped operating the housing, subject to an administrative penalty.
  • Agricultural use and fees. Deemed streamlined agricultural employee housing an agricultural land use exempt from density limits, prohibited discretionary zoning clearances, and allowed local governments to apply written objective standards and impose essential public service fees. Allowed recovery of waived taxes and fees if the owner failed to maintain an operating permit for the first 10 years.
