SB 235

Planning and zoning: housing production report: regional housing need allocation.Ch. 844, Stats. 2019 · chaptered 2019-10-12 · Current law

Key provisions · Claude summary of the digest, not bill text

Allowed the County and City of Napa to share credit for housing production in annual reports, extended RHNA transfer rules to subregional entities, and tied SB 35 eligibility to production report data.

  • Napa production agreement. Authorized the County of Napa and the City of Napa to agree that one jurisdiction may report the completed entitlements, building permits, and certificates of occupancy issued by the other, if certain conditions are met.
  • Hearings and findings. Required both the Board of Supervisors and City Council to hold public hearings and make specified written findings based on substantial evidence before approving the agreement.
  • No net loss preserved. Specified the agreement does not reduce the duty to maintain adequate sites; required jurisdictions to identify replacement sites if an affected site becomes inadequate, with HCD required to notify the Attorney General of violations.
  • Subregional RHNA transfers. Extended the requirement to reduce a county's RHNA share when cities agree to take an equivalent increase to allocations made by a subregional entity.
  • SB 35 eligibility data. Required HCD's streamlining eligibility determination to be based on net new units issued a completed entitlement, building permit, or certificate of occupancy as reported in the annual production report.
  • Coordination. Incorporated additional changes to Government Code Section 65913.4 proposed by AB 1485 and SB 592, operative only under specified enactment conditions.
