Key provisions · Claude summary of the digest, not bill text

Limited ADU impact fees to the floor area above 750 square feet when a lot has no more than two ADUs; takes effect January 1, 2027.

  • Fee only on the excess area. For up to two accessory dwelling units on a lot, impact fees for an ADU larger than 750 square feet of interior livable space remain proportional to the primary dwelling's square footage, but may be charged only on the area above 750 square feet.
  • Three or more ADUs. For properties with more than two ADUs on a lot, impact fees for an ADU over 750 square feet stay proportional to the primary dwelling's square footage, without the excess-area limit.
  • Small units still exempt. Kept the bar on impact fees for ADUs of 750 square feet or less and junior ADUs of 500 square feet or less.
  • Charter cities. Declared the change a matter of statewide concern that applies to all cities, including charter cities.
