Key provisions · Claude summary of the digest, not bill text

Amended the Affordable Housing and High Road Jobs Act of 2022 (AB 2011) so that objective standards cannot prohibit or limit mixed-use development in qualifying housing projects.

  • Mixed use protected. Prohibited the objective standards applied to qualifying use-by-right projects along commercial corridors from prohibiting or otherwise limiting mixed-use development, as defined, in a housing development project.
  • Existing limits retained. Left in place existing rules that objective standards may not preclude the required residential density or force reductions in unit size.
  • Definitions cleanup. Made nonsubstantive changes to the Act's definition provisions.
  • Charter cities. Declared the changes a matter of statewide concern applying to all cities, including charter cities.

The Legislature finds and declares that the provision of adequate housing, in light of the severe shortage of housing at all income levels in this state is a matter of statewide concern and is not a municipal affair as that term is used in Section 5 of Article XI of the California Constitution. Therefore, this act applies to all cities, including charter cities.

No reimbursement is required by this act pursuant to Section 6 of Article XIII B of the California Constitution because a local agency or school district has the authority to levy service charges, fees, or assessments sufficient to pay for the program or level of service mandated by this act, within the meaning of Section 17556 of the Government Code.
