Good Fire Act: Prescribed Fire Liability Pilot Program: burn bosses: California Environmental Quality Act.Ch. 761, Stats. 2026 · chaptered 2026-09-29 · Current law

Key provisions · Claude summary of the digest, not bill text

The broader Good Fire Act on prescribed fire liability and burn bosses added § 21080.49.1, a CEQA exemption for CAL FIRE actions that assist prescribed fire or cultural burning projects; took effect immediately as an urgency statute.

  • New CEQA exemption. § 21080.49.1 exempts actions taken by the Department of Forestry and Fire Protection to assist in implementing prescribed fire or cultural burning projects that do not otherwise require CEQA compliance.
  • Codifies executive order. The digest notes the exemption follows Executive Order N-35-25, which had suspended CEQA to the extent needed for CAL FIRE to help local agencies and practitioners complete beneficial fire projects.
  • Rest of the bill. The bill also indefinitely extended the Prescribed Fire Liability Pilot Program, broadened claims fund eligibility, revised burn boss certification, and allowed waivers of burn permit inspections; it has no direct housing provisions.
