SB 728

Density Bonus Law: purchase of density bonus units by nonprofit housing organizations.Ch. 365, Stats. 2021 · chaptered 2021-09-28 · Later amended

Key provisions · Claude summary of the digest, not bill text

Revised Density Bonus Law requirements for for-sale affordable units, allowing qualified nonprofit housing organizations to purchase them under recorded affordability and equity-sharing contracts.

  • For-sale unit options. Required the developer and city or county to ensure each for-sale density bonus unit is either initially occupied by a household of the required income at an affordable housing cost with an equity sharing agreement, or purchased by a qualified nonprofit housing organization.
  • Nonprofit purchase terms. Required a nonprofit purchase to be under a recorded contract with an affordability restriction, an equity sharing agreement, and a repurchase option giving the nonprofit the first opportunity to buy back the property from a subsequent seller.
  • Eligible nonprofits. Limited the nonprofit option to organizations receiving the property tax welfare exemption for building or rehabilitating homes for sale at cost to low-income families.
  • Cross-references. Updated cross-references in the provisions on local density bonus ordinances and the 2020 incentive calculation exemption.
  • SB 290 coordination. Incorporated additional changes to Government Code Section 65915 proposed by SB 290, operative only if both were enacted and this bill was enacted last.
  • Reimbursement. Provided that state-mandated costs, if determined by the Commission on State Mandates, would be reimbursed under statutory procedures.
