Key provisions · Claude summary of the digest, not bill text

Overhauled Density Bonus Law procedures, adding a floor-area-ratio bonus option, an eligibility determination at completeness, and making bonuses, incentives, and waivers nondiscretionary and exempt from CEQA review.

  • Application-based eligibility. Required a city or county to grant a density bonus, incentives or concessions, and waivers when it determines an application for a housing development meets specified criteria, including affordable or senior unit percentages.
  • FAR bonus option. Allowed an applicant that provides a base density study to elect a density bonus as a percentage increase in maximum floor area ratio, with a related exception to calculating base density in dwelling units per acre.
  • Same-development sites. Recast the geographic placement rule to require density bonuses, incentives, concessions, and waivers on sites that are the subject of the same housing development.
  • Eligibility determination. Required a local government that deems an application complete to also provide a determination that the project is eligible for a density bonus.
  • Incentive calculations. Revised certain calculations governing the number of incentives or concessions an applicant may receive.
  • Nondiscretionary, no CEQA. Specified that granting a density bonus, incentive, concession, or waiver is not discretionary, does not require a general plan, coastal plan, or zoning change, study, or other discretionary approval, and does not require CEQA review.
  • Bill coordination. Incorporated additional changes to Government Code Section 65915 proposed by AB 2480, SB 1383, or both, operative only if enacted and this bill was enacted last; applied to charter cities.
