Revised how modifications to SB 35 streamlined housing approvals are reviewed, tying them to the objective standards in effect when the original application or notice of intent was submitted.

  • Modification standards. Required local governments to approve a modification consistent with the objective zoning, subdivision, and design review standards in effect when the original application or notice of intent was first submitted.
  • Consistent methodology. Required subsequent modifications to be evaluated using the same assumptions and analytical methodology used originally or in a previous modification.
  • Litigation extension. Provided that the extension of approval validity during litigation is not limited to the first modification request.

Section 65913.4 of the Government Code is amended to read:

SEC. 2

The Legislature finds and declares that ensuring access to affordable housing is a matter of statewide concern and is not a municipal affair as that term is used in Section 5 of Article XI of the California Constitution.
