SB 71

California Environmental Quality Act: exemptions: transit projects.Ch. 742, Stats. 2025 · chaptered 2025-10-13 · Current law

Key provisions · Claude summary of the digest, not bill text

Extended and broadened CEQA exemptions for active transportation plans and transit projects in §§ 21080.20 and 21080.25, including a new exemption for projects that pair an exempt transit or active transportation project with a qualifying housing development; took effect January 1, 2026.

  • Plans exempt indefinitely. § 21080.20 no longer sunsets in 2030 and now also exempts transit comprehensive operational analyses and transit route additions, eliminations, or modifications, though individual projects in a plan still need their own review or exemption.
  • Transit exemptions to 2040. § 21080.25 was extended to January 1, 2040, and broadened to cover protection, operation, and maintenance of bus, BRT, light rail, microtransit, paratransit, shuttle, and ferry service and stops using clean vehicles, with near-zero and natural gas fleets eligible only until January 1, 2032.
  • Transit plus housing. New § 21080.25(b)(10) exempts a project combining an exempt transportation project with a housing development project that is subject to nondiscretionary approval or is otherwise CEQA-exempt, without exempting the housing from other laws.
  • Rail and exclusions. Passenger rail projects may use Tier 4 or cleaner locomotives except in serious, severe, or extreme nonattainment areas, and ferry terminals with a notice of preparation before 2026 and most transportation network company services are excluded.
  • Cost thresholds. The $100 million and $50 million thresholds for added review are based on the project engineer's estimate and adjusted every two years for inflation by the Office of Land Use and Climate Innovation; projects still may not require demolition of affordable housing.
