Key provisions · Claude summary of the digest, not bill text

Housing budget trailer bill that revised AB 2011 and Middle Class Housing Act parcel exemptions, created a surplus land exemption for sectional planning areas, and established HHAP round 5 and supplemental Homekey funding, among other housing program changes; took effect immediately.

  • AB 2011 parcel exemptions. Required local exemptions from the Affordable Housing and High Road Jobs Act of 2022 to be adopted by ordinance, with findings of no net loss of realistic residential capacity and completion of all 6th cycle housing element rezonings.
  • Middle Class Housing Act. Required exempted parcels to be subject to a by-right ordinance for density reallocation, and required contractor registration and notice of contracts to the Department of Industrial Relations.
  • Surplus land exemption. Until January 1, 2034, exempted land in a sectional planning area from surplus land disposal requirements under specified conditions, with annual report status, 30-day notice to HCD before declaring exempt surplus land, and civil penalties for violations.
  • HCD program lists. Shifted publication of program lists for prohousing points and for housing element compliance-contingent funding from the Department of Finance to HCD.
  • HHAP round 5. Established round 5 of HHAP with unawarded rounds 3–4 bonus funds, requiring regional applications under approved regionally coordinated homelessness action plans, at least 3 public meetings, 10% for homeless youth, and 75% obligation and 50% expenditure by June 30, 2026.
  • Supplemental Homekey. Made round 5-eligible cities and counties with a housing element eligible for supplemental funding of $100,000,000 in 2023–24 and $260,000,000 in 2024–25.
  • State land and infill. Required DGS to update the excess state land inventory annually from January 1, 2025, removed Excess Sites grant expenditure deadlines, and limited Infill Infrastructure Grant ranking to qualifying infill areas.
  • Other changes. Removed CalHFA from within HCD, revised the tax credit "rural area" definition, created the Employee Housing Regulation Fund, and allowed Homeless Data Integration System data sharing among council member agencies.

The Legislature finds and declares that Section 22 of this act, which amends Section 8257 of the Welfare and Institutions Code, imposes a limitation on the public’s right of access to the meetings of public bodies or the writings of public officials and agencies within the meaning of Section 3 of Article I of the California Constitution. Pursuant to that constitutional provision, the Legislature makes the following findings to demonstrate the interest protected by this limitation and the need for protecting that interest:

By excluding the advisory committee from the requirement that public meetings be conducted at a primary physical location with a quorum of members present, this act reduces travel time and costs to promote participation of advisory committee members.

SEC. 25

This act is a bill providing for appropriations related to the Budget Bill within the meaning of subdivision (e) of Section 12 of Article IV of the California Constitution, has been identified as related to the budget in the Budget Bill, and shall take effect immediately.
