Revised housing element requirements for zoning that allows emergency shelters by right and required jurisdictions to accommodate unmet and carried-over RHNA throughout the planning period.

  • Shelter zoning. Revised requirements for zoning designations allowing residential or mixed use where emergency shelters are permitted without a conditional use or other discretionary permit, and limited shelters to specified written, objective standards.
  • Shelter definition. Specified that emergency shelters include other interim interventions, such as navigation centers, bridge housing, and respite or recuperative care.
  • Shelter site criteria. Required identified shelter sites to be vacant and zoned residential, vacant nonresidential near amenities and services for people experiencing homelessness, or nonvacant and suitable in the planning period; also allowed suitable local government-owned sites.
  • Shelter capacity. Required sufficient sites to accommodate shelter need, with capacity calculated by dividing site square footage by a minimum of 200 square feet per person, except as specified.
  • No net loss. Required the inventory or sites program to accommodate the remaining unmet RHNA share and any unaccommodated RHNA from the prior planning period at all times during the planning period.
  • Density reductions. Prohibited reducing density on any parcel identified to meet the current RHNA or prior-period unaccommodated RHNA without specified written findings supported by substantial evidence.
