Key provisions · Claude summary of the digest, not bill text

Amended the Density Bonus Law to extend 100% affordable project benefits to very low vehicle travel areas, revise affordability and density definitions, and modify parking standards.

  • 100% affordable rents. Required rents for the remaining units in 100% lower income projects to be consistent with CTCAC maximum rent levels for lower income households.
  • Equity sharing. Allowed local governments to defer to a public funding source's recapture provisions when enforcing equity sharing agreements on for-sale units, and deleted duplicative for-sale provisions.
  • VMT-area height bonus. Extended the height increase of up to 3 stories or 33 feet for 100% lower income projects to sites in a very low vehicle travel area, as defined.
  • No density limits. Prohibited maximum density controls on such projects located in a very low vehicle travel area within a designated county, which included San Diego and 16 other listed counties.
  • Density definitions. Added minimum lot area per unit to "development standard" and revised "maximum allowable residential density" to account for specific plans, with the greater density prevailing where zoning and the general plan or specific plan conflict.
  • Parking standards. Prohibited any vehicular parking standards for 100% lower income projects meeting specified criteria, and modified those criteria.
  • AB 682 coordination. Incorporated additional changes to Government Code Section 65915 proposed by AB 682, operative only if both were enacted and this bill was enacted last.
