Key provisions · Claude summary of the digest, not bill text

Strengthened affirmatively furthering fair housing (AFFH) requirements, including a mandatory-duty clarification and new AFFH analysis in the housing element and sites inventory.

  • Mandatory duty. Clarified that a public agency has a mandatory duty to comply with its obligation to affirmatively further fair housing, as a clarification of existing law.
  • Fair housing assessment. Revised the items required in the housing element's fair housing analysis and required it to be done in a specified manner.
  • Historical origins. Required the schedule of actions to assess local and regional historical origins and current policies and practices contributing to identified fair housing factors.
  • Sites inventory and AFFH. Required the inventory of land to analyze the relationship of identified sites to the duty to affirmatively further fair housing, and whether the inventory affirmatively furthers fair housing.
  • Coordination with AB 1398. Incorporated additional changes to Government Code Sections 65583 and 65583.2 proposed by AB 1398, operative only if both were enacted and this bill was enacted last.
