Planning and zoning: housing element.Ch. 374, Stats. 2017 · chaptered 2017-09-29 · Later amended

Key provisions · Claude summary of the digest, not bill text

Expanded annual progress report data, broadened housing element constraints analysis to nongovernmental constraints, and directed HCD to study local development fees.

  • Annual report data. Required the annual report to include housing development applications received, units in all applications, units approved and disapproved in the prior year, and a list of sites rezoned to accommodate unmet RHNA.
  • HCD standards. Required the housing element portion of the report to use HCD-adopted standards, removed the Administrative Procedure Act requirement for HCD forms and definitions, and applied the reporting requirement to charter cities.
  • Constraints analysis. Required governmental constraints analysis to include local ordinances that directly impact the cost and supply of residential development.
  • Nongovernmental constraints. Required analysis of requests to develop below anticipated densities and the time between approval and building permit application, and required the program to address and remove nongovernmental constraints.
  • Fee study. Required HCD, by June 30, 2019, to complete a study on the reasonableness of local fees on new developments, with recommendations on Mitigation Fee Act amendments to substantially reduce residential fees.
  • Coordination. Incorporated additional changes to Government Code Sections 65400 and 65583 proposed by SB 35 and AB 1397, operative only under specified enactment conditions.
