AB 1397

Local planning: housing element: inventory of land for residential development.Ch. 375, Stats. 2017 · chaptered 2017-09-29 · Later amended

Key provisions · Claude summary of the digest, not bill text

Tightened housing element sites inventory standards, requiring sites to be available, served by utilities, and realistically capable of development for designated income levels.

  • Available sites. Required inventory sites to be available, not just suitable, for residential development, including vacant sites and sites with realistic and demonstrated potential for redevelopment during the planning period.
  • Parcel listing and utilities. Required listing by assessor parcel number and required parcels to have sufficient water, sewer, and dry utilities available and accessible, or be in an existing program to secure them.
  • Site capacity by income. Required the inventory to specify for each site the number of units it can realistically accommodate and whether it is adequate for lower, moderate-, or above moderate-income housing.
  • Nonvacant methodology. Required the methodology for additional development potential to consider past experience converting existing uses, current demand for existing uses, and existing leases or contracts that would perpetuate existing uses.
  • By-right rezone sites. Limited by-right use on sites rezoned for unaccommodated lower income need to developments with at least 20% of units affordable to lower income households, and required those sites to have adequate utilities.
  • Coordination with AB 879. Incorporated additional changes to Government Code Section 65583 proposed by AB 879, operative only if both were enacted and this bill was enacted last.
