Key provisions · Claude summary of the digest, not bill text

Strengthened preservation rules for assisted housing developments at risk of conversion by expanding tenant notice requirements and reforming the right of qualified entities to purchase these properties.

  • Tenant notices. Required owners within 3 years of scheduled expiration of rental restrictions to notify prospective tenants at eligibility interviews and existing tenants by posting. Specified that injunctive relief may include reimposing prior restrictions and restitution of improper rent increases, with attorney's fees for prevailing plaintiffs.
  • Qualified purchasers. Limited the opportunity to purchase to organizations that own and operate at least 3 comparable rent- and income-restricted properties under state or federal regulatory agreements, and required HCD certification of their capability, with HCD maintaining a certified list.
  • Offer and acceptance. Required bona fide offers at market value set by negotiation or an appraisal process by HCD-certified appraisers. Barred owners receiving a qualifying offer within 180 days from accepting other offers, requiring them to accept within 90 days or declare under penalty of perjury that they will not sell for at least 5 years.
  • Subsidy renewal. Required owners, once a bona fide offer is made, to take reasonable steps to renew expiring housing assistance contracts or extend available subsidies or use restrictions.
  • Enforcement. Required HCD to refer violations to the Attorney General, monitor compliance, and report to the Legislature, and allowed tenant associations and affected public entities to enforce, with bond waivers and attorney's fees for prevailing plaintiffs.
