SB 21

Single-room occupancy units: demolition and replacement: housing assistance programs: eligibility for homeless individuals and families.Ch. 511, Stats. 2025 · chaptered 2025-10-10 · Current law

Key provisions · Claude summary of the digest, not bill text

Amended the Housing Crisis Act replacement rules in § 66300.6 and added § 66300.6.5, letting cities and counties reduce required replacement units when deed-restricted single-room occupancy buildings are rehabilitated or replaced with larger or improved units; took effect January 1, 2026.

  • Acutely low income counted. Replaced protected units now count toward density bonus or local inclusionary requirements for acutely low income households, in addition to moderate, lower, very low, and extremely low income households.
  • SRO replacement reduction. For deed-restricted SRO buildings lacking a complete private bath and kitchen, § 66300.6.5 lets the jurisdiction reduce replacement units on substantial evidence that the reduction is needed to convert units to studios or larger, add bathrooms, kitchens, or community rooms, improve accessibility, or address health and safety code issues.
  • Affordability and timing. Converted units must be lower income rentals at or below the replaced unit's affordable rent, covenanted for at least 55 years, and completed within four years, with a possible one-year extension for delays outside the proponent's control.
  • Net loss cap. Net SRO loss is capped at 25 percent unless additional units are replaced one-for-one offsite in the same community plan area, redevelopment area, or jurisdiction, or in a high or highest resource area in the same jurisdiction.
  • Tenant protections. Displaced occupants get a right of first refusal, initial rents no more than 5 percent above prior rent, limits on later increases, and full relocation benefits; a replacement housing plan must be approved before any demolition, rehabilitation, or conversion permit issues.
