Farmworker housing: streamlined, ministerial approval: Counties of Fresno, Madera, and Merced.Ch. 490, Stats. 2025 · chaptered 2025-10-10 · Current law

Key provisions · Claude summary of the digest, not bill text

Expanded the streamlined, ministerial approval path for agricultural employee housing in Health and Safety Code § 17021.8 to the Counties of Fresno, Madera, and Merced and raised the unit cap there to 150; took effect January 1, 2026.

  • New eligible counties. Development in Fresno, Madera, and Merced Counties qualifies, like Santa Clara and Santa Cruz, if it is within 15 miles of land designated farmland or grazing by the Department of Conservation and not on or adjoining a site more than one-third dedicated to industrial use, even without an agricultural general plan designation.
  • Larger projects. The maximum eligible development in the five named counties is 150 single-family or household units or spaces, up from 36 elsewhere; dormitory-style housing remains ineligible.
  • Unchanged safeguards. Projects must still avoid the coastal zone, wetlands, high fire hazard zones, floodways, and other listed sites, be operated by a certified qualified affordable housing organization, and carry a 55-year affordability covenant for lower income agricultural employees.
  • Ministerial process. Local review stays objective and time-limited (30 or 60 days for consistency findings and 90 or 180 days for review, by project size), and approval is not a discretionary act under CEQA.
