AB 36

Housing elements: prohousing designation.Ch. 485, Stats. 2025 · chaptered 2025-10-10 · Later amended

Key provisions · Claude summary of the digest, not bill text

Moved HCD's prohousing designation program onto permanent regulations and added accommodations for small rural jurisdictions.

  • Permanent regulations. Required HCD to designate jurisdictions as prohousing pursuant to permanent regulations, instead of emergency regulations.
  • Small rural review. Beginning with the 7th housing element cycle, required HCD, on request and to the extent feasible, to evaluate a small rural jurisdiction's housing element submission materials when determining prohousing eligibility, for jurisdictions with a compliant housing element.
  • Renewal interval. Prohibited HCD from requiring small rural jurisdictions to renew their prohousing designation for at least 4 years.
  • Definition. Defined a "small rural jurisdiction" as a city with fewer than 25,000 persons or a county with fewer than 200,000 persons.
  • Coordination with SB 262. Incorporated additional changes to Government Code Section 65589.9 proposed by SB 262, operative only if both were enacted and this bill was enacted last.
