Planning and zoning: revision of housing element: regional housing need allocation appeals: Southern California Association of Governments.Ch. 572, Stats. 2024 · chaptered 2024-09-25 · Current law

Key provisions · Claude summary of the digest, not bill text

Shortened RHNA appeal and review timelines and gave most SCAG-region jurisdictions 24 months after every 2nd RTP update to revise their 7th-cycle and later housing elements.

  • Shorter appeal window. Reduced the period to appeal a draft RHNA allocation from 45 days to 30 days and reduced required notice before the appeal hearing from 21 days to 10 days.
  • HCD review. Required submission of the proposed final allocation plan to HCD and reduced HCD's consistency review of the final plan to 15 days.
  • Flexible timelines. Allowed councils of governments to reduce certain time periods, but not below 10 days, to facilitate earlier adoption of the final allocation plan.
  • SCAG housing element timing. Extended the deadline for certain SCAG-region jurisdictions to revise housing elements to 24 months after every 2nd RTP update for the 7th and later revisions, excluding Orange, Riverside, San Bernardino, and Ventura Counties and their cities.
  • Revision date cap. Conditioned the deemed next housing element revision date (RTP adoption plus 18 months) on it being no more than 8 years after the previous deadline.
  • Bill coordination. Incorporated changes proposed by SB 7 and AB 2023, each operative only if enacted and this bill was enacted last.
