SB 713

Planning and zoning: density bonuses: development standard.Ch. 784, Stats. 2023 · chaptered 2023-10-11 · Later amended

Key provisions · Claude summary of the digest, not bill text

Clarified that development standards adopted by voter initiative or referendum are subject to the Density Bonus Law's waiver and reduction provisions.

  • Voter-enacted standards. Specified that "development standard" includes standards adopted by the local government or enacted by its electorate through local initiative or referendum, whether that power derives from the California Constitution, statute, or local charter or ordinances.
  • Physical preclusion rule. Applied the existing prohibition on development standards that physically preclude density bonus projects to these voter-enacted standards.
  • Charter cities. Declared the changes a matter of statewide concern applying to all cities, including charter cities.
  • Coordination. Incorporated additional changes to Government Code Section 65915 proposed by AB 323 and AB 1287, operative only if enacted together and this bill was enacted last.
