Key provisions · Claude summary of the digest, not bill text

Set special regional transportation plan and housing element schedules for SANDAG and its member jurisdictions, aligning the 6th cycle RHNA with SANDAG's 2015 sustainable communities strategy.

  • 2015 RTP remains. Kept SANDAG's October 9, 2015, regional transportation plan, sustainable communities strategy, and EIR in effect until its next RTP update, which was required by December 31, 2021.
  • CEQA exemption. Provided that a specified federal-compliance update to the 2015 RTP is not a project under CEQA.
  • SCS implementation report. Required SANDAG to submit an implementation report tracking its most recent sustainable communities strategy when submitting a strategy to the State Air Resources Board.
  • Congested corridors. Until December 31, 2021, required SANDAG-nominated Solutions for Congested Corridors projects to also meet eligibility requirements of at least one of 3 other specified programs.
  • Housing element deadlines. Required SANDAG-region local governments to adopt their 6th housing element revision by April 30, 2021, and their 7th revision no later than 18 months after SANDAG's first RTP update adopted in 2029.
  • RHNA consistency. Required the 6th cycle final housing need allocation plan to be evaluated for consistency using the sustainable communities strategy in the 2015 RTP.

Preamble

SECTION 1. The Legislature finds and declares that the San Diego Association of Governments (SANDAG) requires additional time to update its sustainable communities strategy and regional transportation plan because of the significant organizational changes to SANDAG resulting from the enactment of Assembly Bill 805 (Chapter 658 of the Statutes of 2017), which modified the governing structure of SANDAG.

SEC. 6

The Legislature finds and declares that a special statute is necessary and that a general statute cannot be made applicable within the meaning of Section 16 of Article IV of the California Constitution because of the San Diego Association of Governments’ specialized goal of maintaining the schedule for the regional housing needs planning process carried out by the local governments in the San Diego region for the sixth cycle and compliance with federal laws, while giving the agency sufficient time to carry out the additional planning efforts and environmental analyses required to meet the increased State Air Resources Board greenhouse gas emission reduction targets for the region for this and future updates to its regional transportation plan.

SEC. 7. Section 5.5 of this bill incorporates amendments to Section 65588 of the Government Code proposed by both this bill and Assembly Bill 139. That section of this bill shall only become operative if (1) both bills are enacted and become effective on or before January 1, 2020, (2) each bill amends Section 65588 of the Government Code, and (3) this bill is enacted after Assembly Bill 139, in which case Section 5 of this bill shall not become operative.

SEC. 8

If the Commission on State Mandates determines that this act contains costs mandated by the state, reimbursement to local agencies and school districts for those costs shall be made pursuant to Part 7 (commencing with Section 17500) of Division 4 of Title 2 of the Government Code.
