Housing development: streamlining.Ch. 663, Stats. 2019 · chaptered 2019-10-09 · Later amended

Key provisions · Claude summary of the digest, not bill text

Amended SB 35 streamlined ministerial approval, adding a Bay Area moderate-income option, clarifying consistency and approval duration, protecting subsequent permits, and expanding CEQA exemptions.

  • Bay Area affordability option. Allowed developments in the San Francisco Bay area to instead dedicate 20% of units to households at or below 120% AMI, averaging at or below 100% AMI, with costs capped at 30% of household income for 80%–120% AMI units.
  • Covenants and stacking. Required recorded restrictions for moderate income units and allowed an affordable unit to satisfy both these and other state or local affordability requirements.
  • Square footage. Excluded underground space, such as basements and underground parking, from the 2/3 residential square footage calculation.
  • Consistency standard. Provided that a development is consistent with objective standards if substantial evidence would allow a reasonable person to conclude it is consistent.
  • Approval duration. Kept approvals valid for 3 years from the final action or a final judgment upholding approval, except as specified.
  • Subsequent permits. Required issuance of subsequent permits that substantially comply with the approved development and barred procedures not imposed on other developments.
  • CEQA exemptions. Exempted BART land leases, conveyances, and related decisions, and approvals of necessary improvements on local government or BART land, for qualifying affordable SB 35 projects.
  • Subsidized definition. Removed the permanent affordability requirement from the definition of "subsidized" for skilled and trained workforce purposes.
