Extended the CEQA exemption for affordable housing projects in § 21080.40 to January 1, 2037, and expanded it to housing projects for University of California, California State University, and community college campuses; takes effect January 1, 2027.

  • Sunset extended. The exemption's repeal date moved from January 1, 2033, to January 1, 2037.
  • Campus housing added. A "public university or public college housing project" covers housing for students, faculty, or staff of UC, CSU, or community college campuses, including dining, academic, and student support spaces.
  • Campus project criteria. Campus projects must meet the § 65912.130 labor standards (and § 65912.131 for 50 or more units), be infill with urban uses on at least 75 percent of the perimeter, and be in an urbanized area, near high-quality transit, in a very low vehicle travel area, or near six or more listed amenities.
  • Actions covered. Exempt actions include entitlements, land leases or conveyances, financial assistance, and rezonings, specific plan, general plan, or higher education land use plan amendments needed solely for the project.
  • Site conditions. Both project types must meet the site exclusions of § 65913.4(a)(6)(B)-(K), tribal cultural resource and Phase I hazards requirements, and, where multifamily housing is not a permitted use, freeway, oil and gas facility, and very high fire hazard severity zone limits; the tax credit regulatory agreement requirement applies only to affordable housing projects.
