SB 838

Housing Accountability Act: housing development projects.Ch. 789, Stats. 2025 · chaptered 2025-10-13 · Current law

Key provisions · Claude summary of the digest, not bill text

Narrowed the Housing Accountability Act's definition of a mixed-use "housing development project" to exclude projects with hotel or other transient lodging components.

  • Transient lodging excluded. Required, for mixed-use developments with at least 2/3 of new or converted square footage designated for residential use, that no portion of the project be designated for use as a hotel, motel, bed and breakfast inn, or other transient lodging, except as specified.
  • Cross-references. Corrected cross-references within the Housing Accountability Act.
  • AB 1308 coordination. Incorporated additional changes to Government Code Section 65589.5 proposed by AB 1308, operative only if both were enacted and this bill was enacted last.
