Key provisions · Claude summary of the digest, not bill text

Revised Density Bonus Law provisions for student housing, redefining eligible developments and students and adding a sliding-scale bonus, a second incentive, and zero parking per bedspace.

  • Student housing defined. Defined a student housing development as one with bedrooms of 2 or more bedspaces with shared or private bathroom, living room, laundry, and kitchen access.
  • Eligible students. Allowed occupancy by students enrolled currently or in the past 6 months in at least 6 units at an institution of higher learning.
  • Verification alternative. Allowed eligibility, as an alternative to an operating agreement or master lease, if the developer established a system to confirm all renters are students.
  • Affordability flexibility. Prohibited the 55-year affordability restriction from tying a reserved lower income bed to a specific bedroom.
  • Bonus and incentives. Replaced the flat 35% bonus with a bonus that varies by the percentage of low-income units, and granted 2 incentives or concessions for projects with at least 23% of units for lower income students.
  • Parking. Added a parking ratio of zero spaces per bedspace in a student housing development.
  • AB 2694 coordination. Incorporated additional changes to Government Code Section 65915 proposed by AB 2694, operative only if both were enacted and this bill was enacted last.
