Key provisions · Claude summary of the digest, not bill text

Revised how for-sale density bonus units may be sold to qualified nonprofits and imposed civil penalties for selling inclusionary ownership units to non-income-qualified buyers.

  • Density bonus sales. Required for-sale density bonus units to be initially sold to and occupied by an income-qualified household, or, if not purchased within 180 days after the certificate of occupancy, sold to a qualified nonprofit housing organization.
  • Nonprofit criteria. Required the nonprofit to hold the welfare exemption, have an IRS tax-exempt determination letter, be California-based, primarily develop and preserve affordable ownership housing, and use repurchase options with equity sharing or recorded affordability restrictions.
  • Inclusionary units. Prohibited developers from selling inclusionary owner-occupancy units to non-income-qualified purchasers, except to a qualified nonprofit if no qualifying buyer purchased within 180 days of the certificate of occupancy.
  • Civil penalty. Made each noncompliant offering a violation subject exclusively to a civil penalty of up to $15,000, recoverable by the county counsel or city attorney.
  • Bill coordination. Incorporated additional changes to Government Code Section 65915 proposed by SB 713 and AB 1287, operative only if enacted and this bill was enacted last; applied to charter cities.
