Density Bonus Law: maximum allowable residential density: additional density bonus and incentives or concessions.Ch. 755, Stats. 2023 · chaptered 2023-10-11 · Later amended

Key provisions · Claude summary of the digest, not bill text

Amended the Density Bonus Law to allow a stacked additional density bonus for projects adding more very low income or moderate-income units, and increased incentives and concessions.

  • Maximum allowable density. Redefined "maximum allowable residential density" as the greatest number of units allowed under the zoning ordinance, specific plan, or general plan land use element, and removed the rule that the greater density prevails when they conflict.
  • Additional density bonus. Required an additional density bonus when a project already providing 24% lower income, 15% very low income, or 44% moderate-income units adds further rental or for-sale units affordable to very low income or moderate-income households.
  • More concessions. Required 4 incentives or concessions for projects with at least 16% very low income units or at least 45% moderate-income for-sale units, and increased incentives or concessions for 100% lower income projects from 4 to 5.
  • Documentation limits. Limited local requests for eligibility documentation to the requested density bonus and parking ratios, removing incentives, concessions, and waivers from that allowance.
