Key provisions · Claude summary of the digest, not bill text

Clarified and strengthened SB 35 streamlined ministerial approval and applied impact fee nexus study standards to charter cities.

  • Ministerial approval. Clarified that SB 35 developments are not subject to a conditional use permit or any other nonlegislative discretionary approval, and required approval if the development is consistent with objective planning standards.
  • Affordability calculation. Clarified that the minimum affordable unit percentage is calculated before any density bonus.
  • Hazardous sites. Allowed sites a local agency has determined suitable for residential use, or underground storage tank sites with a uniform closure letter, to qualify despite hazardous waste site status.
  • Application materials. Barred finding a conflict with objective standards based on missing application materials when the application contains substantial evidence of consistency, including for modifications.
  • Design review conflicts. Required written documentation of which objective design review or public oversight standards a project conflicts with.
  • Fee nexus studies. Defined "city" in the impact fee nexus study requirements of the Mitigation Fee Act to include charter cities.
  • SB 6 coordination. Incorporated additional changes to Government Code Section 65913.4 proposed by SB 6, operative only if both were enacted and this bill was enacted last.

That section of this bill shall only become operative if (1) both bills are enacted and become effective on or before January 1, 2023, (2) each bill amends Section 65913.4 of the Government Code, and (3) this bill is enacted after Senate Bill 6, in which case Section 1 of this bill shall not become operative.
