Planning and zoning: housing: postentitlement phase permits.Ch. 651, Stats. 2022 · chaptered 2022-09-28 · Current law

Key provisions · Claude summary of the digest, not bill text

Set deadlines and online processing requirements for postentitlement phase permits (such as building permits) for housing development projects, making missed deadlines a violation of the Housing Accountability Act.

  • Application checklists. Required cities and counties, by January 1, 2024, to compile a list of information needed for postentitlement phase permits and post examples of complete approved applications and permit sets for at least 5 types of housing development projects.
  • Online permitting. Required local agencies, on dates set by population size, to allow postentitlement permits to be applied for, completed, and retrieved online, to accept email applications until then, and to provide permit processing status.
  • Review time limits. Established time limits for completeness and compliance review and for approval or denial, and made failure to meet them a disapproval of the project and a violation of the Housing Accountability Act.
  • Coastal Commission exclusion. Excluded permits required and issued by specified agencies, including the California Coastal Commission, from these provisions.
  • Affordable project vesting. Redefined "affordable housing project" for preliminary application vesting to require 55-year restrictions for rentals and 45-year restrictions for owner-occupied units, or an equity sharing agreement with the first purchaser.

The Legislature finds and declares that access to affordable housing is a matter of statewide concern and is not a municipal affair as that term is used in Section 5 of Article XI of the California Constitution. Therefore, Sections 2 and 3 of this act adding Sections 65913.3 and 65913.3.5 to the Government Code applies to all cities, counties, and cities and counties, including charter cities, counties, and cities and counties.

SEC. 5. No reimbursement is required by this act pursuant to Section 6 of Article XIII B of the California Constitution because a local agency or school district has the authority to levy service charges, fees, or assessments sufficient to pay for the program or level of service mandated by this act, within the meaning of Section 17556 of the Government Code.
