AB 787

Planning and zoning: housing element: converted affordable housing units.Ch. 350, Stats. 2021 · chaptered 2021-09-28 · Current law

Key provisions · Claude summary of the digest, not bill text

Allowed jurisdictions to count units converted to deed-restricted moderate-income rental housing toward up to 25% of their moderate-income RHNA in annual reports.

  • Conversion credit. Authorized a planning agency to report, for up to 25% of its moderate-income RHNA, units in existing multifamily buildings converted to deed-restricted moderate-income rental housing through affordability covenants.
  • Eligibility criteria. Required, among other things, that preconversion rent was not affordable to very low, low-, or moderate-income households and that initial postconversion rent is at least 10% below the average rent of the prior 12 months.
  • RHNA reduction. Allowed the city or county to reduce its share of regional housing need for that income category on a unit-for-unit basis.
  • Timing. Did not require HCD to implement the provisions until January 1, 2023; reports issued after that date may include conversions on or after January 1, 2022.
