Key provisions · Claude summary of the digest, not bill text

Added public review requirements for draft housing elements, revised HCD review timelines, and expanded the laws HCD and the Attorney General can enforce.

  • 30-day public review. Required the first draft housing element revision to be available for public comment for at least 30 days, followed by at least 10 business days to consider and incorporate comments before submittal to HCD.
  • Subsequent drafts. Required subsequent draft revisions to be posted online and emailed to individuals and organizations that requested housing element notices.
  • HCD review hold. Prohibited HCD from reviewing a first draft until the public comment and consideration periods were completed.
  • HCD timelines. Required HCD to report findings within 90 days of the first draft submittal for each revision, or within 60 days for subsequent draft amendments or adoptions.
  • Expanded enforcement. Added the Housing Crisis Act of 2019 and other laws to those whose violation requires HCD notice and allows Attorney General action, authorized HCD to appoint other counsel if the AG declines, and specified the statute of limitations.
  • Coordination with SB 478. Incorporated additional changes to Government Code Section 65585 proposed by SB 478, operative only if both were enacted and this bill was enacted last.
